The Senior Contracts Engineer (CE) will provide senior level assistance to the Resident Engineers (REs), Chief Resident Engineer (CRE) and Engineer/Project Manager with regard to coordination and management of contract administration activities. The Senior CE will report directly to the RE. VERY IMPORTANT: please note this will be a resident site position and R&R is limited to one weekend a month.
The Senior CE will assist the REs and CRE to:
- Administer construction contracts in accordance with the applicable Conditions of Contract.
In this regard the Senior CE will assist the REs and CRE in the:
- Interpretation of the Contracts including the processes relating to the adjudication of claims.
- Coordination with the Chief Design Engineer, REs and CRE to ensure timely distribution of construction drawings to the Contractor and the supervision staff.
- Coordination with the Quantity Surveyor and RE to ensure that all survey work required for measurement and verification of quantities is carried out timeously.
- Evaluation and approval of financial submissions from the Contractor after due consultation with the REs, CRE, Employer and the Contractor where necessary, in respect of:
- Monthly statements and payment certificates, and
- Amounts to which the Contractor considers himself entitled in claims.
- Provision of support to technical staff with reviews and comments on technical submissions from the Contractor such as, Programme, Design modifications, Method Statements & Procedures, Contractor’s Proposals, Contractor’s Designs &, Drawings and Maintenance Manuals.
- Evaluation of the need for Variations after due consultation with the REs, CRE, Employer and the Contractor and coordinating the issue of Variations in accordance with procedures agreed with Employer.
- Provision of support with respect to formulation and issue of written instructions to the Contractor after due consultation with the REs, CRE, Employer and the Contractor as necessary;
- Coordination, review and formalisation of standardised quality control and contract forms.
- Provision of support as necessary to ensure maintenance of construction supervision records and progress reports, technical records (including geotechnical test results) and Instructions, as well as records of all other appropriate site information such as weather, labour etc.
- Evaluation with RE of requests to subcontract and providing consent to subcontract.
- Coordination and contributing to the overall reporting requirements on progress, costs, cash flow forecasts, financial reviews and the Contractor’s performance with regard to Preference targets, as well as provision of timeous notification to the Employer of potential deviations from the project objectives.
- Regular liaison with the Employer and the Contractor on technical, contractual and financial issues, as well other outside parties on matters relating to management and interpretation of the contract through the REs, CRE, Employer and the Contractor; and
- Provision of support and facilitation with the resolution of disputes between the Employer and the Contractor up to and including the process of amicable settlement, but excluding any further preparation for and participation in any legal or arbitration proceedings unless MSKC is expressly instructed by the Employer.
The Senior CE will further support the FIDIC Engineer is matters of claims, including where necessary the drafting of acknowledgement of claims and initial responses to claims.
